Armed Occupation Act
On August 4,1842 the US Congress passed the Armed Occupation Act. This was an act to provide for the armed occupation and settlement of the unsettled part of the
Peninsula of East Florida.
Those desiring land had to apply to the Register of the Land Office for a permit to settle on 160 acres on the south side of a line running roughly from Palatka to
Gainsville. They had to apply before August of 1843 as this act was only to be in effect for one year.
Applicants had to be the head of a family or a single person over the age of eighteen. They were required to be a resident of Florida and their requested land could not be within two miles of any military post.
They had to be capable of bearing arms, to clear, enclose and cultivate at least five of their acres and to erect a house fit for habitation and to live there for five
years.
Two registration locations were set up, one at Newnansville and one at St. Augustine. There were 368 permits registered at St. Augustine for settlers along
the East Coast of Florida.
These 368 permits are listed in a letter from Thomas H. Blake, Commissioner of the General Land Office to the U. S. House of Representatives. This is listed as
Document No. 70, 28th Congress, 1st Session.
Because the Settlements were so spread out travel from one place to another was very difficult. In addition, on July 12, 1849 there was a problem with some of
the Indians near the Indian River Settlement and after several people were killed many other fled the area. Some of the refugees stopped at Cape Canaveral
lighthouse and some continued on to St. Augustine. Others returned to their previous homes further north. While some people returned to their homes when
things quieted down, it is known that a number of them did not return for quite awhile, and some took up residence elsewhere.
Because of these problems the 1850 Census missed a number of people, and found others in places of refuge. So to supplement the 1850 census for the East
Coast of Florida this listing of permits is helpful for the researcher.
